PLEASE READ THIS REFUND POLICY CAREFULLY BEFORE PURCHASING A SUBSCRIPTION. BY SUBSCRIBING TO OUR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS REFUND POLICY.
THIS REFUND POLICY IS HIGHLY RESTRICTIVE. DYDOMITE DOES NOT OFFER REFUNDS EXCEPT IN EXTREMELY LIMITED CIRCUMSTANCES OUTLINED BELOW. BY PURCHASING ANY SUBSCRIPTION OR MAKING ANY PAYMENT, YOU EXPLICITLY ACKNOWLEDGE AND ACCEPT THESE TERMS.
This Refund Policy outlines the terms and conditions for refunds related to your use of the DYDOMITE interactive feed presentation service (the "Service"). By using the Service, you agree to abide by the terms of this Refund Policy.
1. No-Refund Policy
ALL PAYMENTS MADE TO DYDOMITE ARE FINAL AND NON-REFUNDABLE.
When you purchase a subscription plan or make any payment to DYDOMITE, you acknowledge and agree that your purchase is final and that no refunds will be provided under any circumstances, including but not limited to:
- Dissatisfaction with the Service
- Inability to use the Service due to technical issues on your end
- Changes to the Service or its features
- Termination of your account for any reason
- Accidental or unintended purchases
- Non-use of the Service after purchase
- Early cancellation of a subscription plan
- Change of mind after purchase
- Finding a similar service at a lower price
- Poor internet connectivity affecting service performance
- Being unaware of automatic renewal terms
- Any other reason not explicitly covered under the limited exceptions in Section 2
This strict no-refund policy applies to all subscription plans, including monthly, annual, and enterprise plans, and to all features and add-ons purchased through the Service.
2. Limited Exceptions
Notwithstanding our strict no-refund policy, DYDOMITE may, at its sole and absolute discretion, consider refund requests in the following extremely limited circumstances:
2.1 Service Unavailability
If the DYDOMITE Service is completely unavailable and inaccessible for a continuous period of more than 72 hours due entirely to DYDOMITE's fault, and you have reported the issue to our support team within 24 hours of the outage beginning, we may consider a partial, prorated refund for the affected period only.
To qualify for this exception, you must provide detailed documentation of the service outage, including timestamps, error messages, and evidence that the issue was not related to your internet connection, devices, or any third-party service. You must also demonstrate that you attempted to access the service from at least three different devices and internet connections during the outage period.
2.2 Unauthorized Charges
If you discover unauthorized charges on your account that are definitively proven to be the result of a security breach of DYDOMITE's systems (and not due to compromise of your account credentials or payment methods), we may consider a refund for those specific unauthorized charges.
To qualify for this exception, you must notify us within 48 hours of the unauthorized charge appearing on your account and provide substantial evidence that the charge was unauthorized and resulted from a breach of DYDOMITE's systems. This evidence must include a formal police report documenting the unauthorized transaction and a written statement from your payment provider confirming that the transaction was fraudulent. You must also cooperate fully with any investigation we conduct into the matter.
2.3 Billing Errors
If a verifiable technical error in our billing system results in you being charged an amount that significantly exceeds your subscription plan's advertised price (more than 50% above the correct price), we may consider a partial refund limited to the excess amount charged.
To qualify for this exception, you must notify us within 7 days of the incorrect charge and provide clear evidence of the billing error, including screenshots of the advertised price, your payment confirmation, and bank statements demonstrating the excessive charge. We reserve the right to verify this information with our payment processor and internal records.
3. Refund Request Process
For the limited exceptions outlined in Section 2, the following strict process must be followed:
- Submit a detailed written refund request to billing@dydomite.com within the timeframes specified above.
- Include your full name, email address associated with your account, date of purchase, amount paid, and specific payment method used.
- Provide comprehensive documentation supporting your refund request, including timestamps, error messages, screenshots, and any other relevant evidence.
- Clearly explain why your situation falls under one of the limited exceptions in Section 2.
- Include a signed attestation that all information provided is true and accurate to the best of your knowledge.
DYDOMITE reserves the right to request additional information and documentation before making a determination on any refund request. All decisions regarding refund requests are final and at DYDOMITE's sole discretion.
If a refund is approved, it will typically be processed within 30 business days and will be issued using the same payment method used for the original purchase.
DYDOMITE reserves the right to deny any refund request if:
- The request is submitted after the specified timeframes
- The documentation provided is insufficient, incomplete, or fraudulent
- The issue does not meet our criteria for the limited exceptions
- You have violated our Terms of Service in any way
- You have previously requested or received a refund for any reason
4. Cancellation of Subscription
You may cancel your subscription at any time through your account settings or by contacting customer support. However, cancellation does not entitle you to a refund for the current billing period.
When you cancel your subscription:
- Your account will remain active until the end of your current billing period.
- You will not be charged for future billing periods.
- No refunds will be issued for the remaining unused portion of your current billing period.
- You will lose access to all premium features at the end of your current billing period.
It is your responsibility to cancel your subscription before it renews if you do not wish to be charged for the next billing period. No refunds will be provided for failure to cancel a subscription before renewal.
To cancel your subscription, you must follow the exact cancellation procedure specified in your account settings. Simply stopping use of the Service or deleting your account does not cancel your subscription or entitle you to a refund.
5. Automatic Renewal and Payment Authorization
BY SUBSCRIBING TO OUR SERVICE, YOU EXPRESSLY AUTHORIZE DYDOMITE TO AUTOMATICALLY CHARGE YOUR PAYMENT METHOD ON FILE FOR THE SUBSCRIPTION FEE UPON EACH RENEWAL DATE.
Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 48 hours before the renewal date. For monthly subscriptions, renewal occurs every 30 days from the initial subscription date. For annual subscriptions, renewal occurs on the anniversary of your initial subscription date.
If your payment method is declined or expires, we may attempt to process the charge multiple times and/or attempt to charge any other payment method you have on file with us. If we are unable to collect payment, your account may be suspended or terminated at our discretion.
YOU ACKNOWLEDGE THAT DYDOMITE IS NOT REQUIRED TO PROVIDE A REMINDER OR NOTICE BEFORE CHARGING YOU FOR AUTOMATIC RENEWAL, ALTHOUGH WE MAY DO SO AS A COURTESY.
6. Free Trial Conversion
If you signed up for a free trial that automatically converts to a paid subscription, you acknowledge that:
- Your subscription will automatically begin and you will be charged at the end of the free trial period unless you cancel before the trial ends.
- It is your responsibility to cancel before the free trial period ends if you do not wish to be charged.
- No refunds will be provided if you fail to cancel before the free trial period ends.
We send a reminder email before your free trial ends, but we are not responsible if you do not receive or read this email. It remains your responsibility to track your free trial period and cancel if you do not wish to continue with a paid subscription. NO EXCEPTIONS WILL BE MADE FOR FAILURE TO CANCEL BEFORE A FREE TRIAL EXPIRATION.
7. Enterprise Plan Purchases
For Enterprise Plan purchases governed by a separate written agreement, the refund terms in that agreement supersede this Refund Policy. If no specific refund terms are included in the Enterprise agreement, this Refund Policy applies in full.
Unless explicitly stated otherwise in a written agreement signed by an authorized DYDOMITE representative, all Enterprise Plan purchases are non-refundable.
If you are considering an Enterprise Plan, we strongly recommend that you:
- Thoroughly test the Service using our free trial option before purchase
- Ensure the Service meets all your requirements and technical specifications
- Understand that once purchased, the Enterprise Plan cannot be refunded regardless of your satisfaction or usage
8. Payment Processing Issues
DYDOMITE is not responsible for any fees, charges, or expenses imposed by your payment provider, bank, credit card issuer, or financial institution in connection with your purchase or any refund (if approved). These may include foreign currency conversion fees, international transaction fees, overdraft fees, or other charges.
If a refund is approved, it will be processed in the original currency of the transaction. DYDOMITE is not responsible for any losses due to currency exchange rate fluctuations.
You are solely responsible for ensuring that your payment information is accurate and up-to-date. DYDOMITE is not responsible for charges that fail due to expired or canceled credit cards, insufficient funds, or other issues with your payment method.
9. Pricing Changes
DYDOMITE reserves the right to change the pricing of our subscription plans at any time. If pricing changes occur, they will apply to your subscription at the next renewal period.
Price increases or decreases do not entitle you to a refund for current subscription periods. If you continue to use the Service after a price change has been announced, you accept the new pricing.
10. Downtime and Service Interruptions
Occasional downtime and service interruptions are an unavoidable aspect of online services. DYDOMITE makes no guarantee of uninterrupted service availability.
Short-term outages, planned maintenance windows, slow performance, or intermittent connectivity issues do not qualify for refunds under any circumstances.
Only complete service unavailability lasting more than 72 continuous hours, as outlined in Section 2.1, may be considered for a partial refund at our sole discretion.
11. Feature Changes and Deprecation
DYDOMITE reserves the right to modify, update, or discontinue features of the Service at any time. We may also add new features or functionality to the Service.
Changes to features, including removal of features, addition of new features, or changes to how features work, do not entitle you to a refund regardless of how these changes affect your use of the Service.
12. Intellectual Property and Usage Rights
Payment for a subscription provides you with a limited license to use the Service as outlined in our Terms of Service. Your payment does not grant you any ownership rights to the Service or its underlying technology.
Disputes regarding intellectual property rights or the scope of the license granted do not entitle you to a refund.
13. Termination for Violation of Terms
If your account is terminated due to violation of our Terms of Service, Acceptable Use Policy, or any other applicable terms or policies, you are not entitled to a refund of any kind.
Violations that may result in termination without refund include, but are not limited to: sharing account credentials, unauthorized use of content, abusive behavior, exceeding usage limits, attempting to reverse engineer the Service, or any activity that violates applicable laws or regulations.
14. Data Loss
DYDOMITE is not responsible for any loss of data that may occur during your use of the Service. You are solely responsible for maintaining backups of your content.
Data loss, whether due to user error, service issues, or any other cause, does not entitle you to a refund.
15. Acceptance of Risk
BY PURCHASING A SUBSCRIPTION TO THE SERVICE, YOU EXPRESSLY ACCEPT ALL RISKS ASSOCIATED WITH USING ONLINE SERVICES, INCLUDING THE RISK OF SERVICE INTERRUPTIONS, FEATURE CHANGES, DATA LOSS, AND THE POSSIBILITY THAT THE SERVICE MAY NOT MEET ALL YOUR EXPECTATIONS OR REQUIREMENTS. YOU ACKNOWLEDGE THAT THESE RISKS ARE NOT GROUNDS FOR A REFUND.
16. Changes to This Refund Policy
We reserve the right to modify this Refund Policy at any time. Any changes will be effective immediately upon posting the updated policy on our website. Your continued use of the Service after any changes to the Refund Policy constitutes your acceptance of the revised policy.
We encourage you to review this Refund Policy periodically to stay informed about our refund practices.
17. Legal Rights
This Refund Policy does not affect any legal rights that cannot be excluded under applicable law. However, to the maximum extent permitted by law, DYDOMITE disclaims all warranties and limits its liability as set forth in our Terms of Service.
BY USING OUR SERVICE, YOU ACKNOWLEDGE THAT THE LIMITATIONS ON REFUNDS SET FORTH IN THIS POLICY ARE REASONABLE AND APPROPRIATE, AND YOU AGREE TO BE BOUND BY THEM.
